CRC MANUFACTURING, INC.
LIMITED PRODUCT WARRANTY

The following questions and answers constitute the limited product warranty of CRC Manufacturing, Inc., an Alabama corporation ("CRC"), to its customers who purchase products manufactured by CRC.


Who may make claims under this warranty?
This warranty is for the benefit of customers of CRC who purchase products from CRC that are manufactured by CRC, and claims under this warranty may be made only by such customers.


What is the scope of this warranty?
CRC warrants to its customer that the products it manufactures and which the customer purchases from it are free from defects in material and workmanship and conform to the specifications to which CRC has agreed to manufacture them.


How long do I have to make a claim under this warranty?
You must make a written warranty claim within fifteen (15) days of the first occurrence of a malfunction covered by this warranty.


How long does this warranty last?
To be covered by this warranty, a product malfunction must occur within twelve (12) months from the date of invoice from CRC.


What will CRC do in response to a valid claim under this warranty?

CRC will respond to a valid warranty claim in one of the following ways, at its election:

  • It will repair or replace the defective product; or
  • It will issue a credit to the customer in an amount not to exceed the purchase price for the defective product.


What will I need to do after I make a warranty claim?
If asked by CRC, you will need to make the defective product available for inspection by CRC and/or return the defective product to CRC, with shipping charges prepaid.


When I make a warranty claim in writing, should I send the product with the claim?
No. You should not return the allegedly defective product, unless and until CRC requests its return in writing.


When will I find out how CRC plans to handle my warranty claim?
CRC will respond to your written warranty claim within 15 days of its actual receipt of the claim. If CRC asks you to send in the product, it will notify you within 15 days of receipt of the product whether it is accepting or denying your warranty claim and, if accepted, whether it will repair, replace, or issue a credit for, the defective product.


What type of damage is not covered under this warranty?
This warranty only covers damage resulting from defects in material and workmanship. All other defects are outside of the coverage of this warranty, specifically including, without limitation defects arising from normal wear, abuse, alteration, accident, misuse or failure to follow CRC's instructions for use and maintenance. Also included (outside of warranty coverage) would be any damage arising from sandblasting by anyone other than CRC.


If CRC repairs or replaces a defective product, does it warrant the repaired or replaced product?
Replacement products or parts of products which are repaired under this warranty continue to be covered under the terms of this warranty for the remainder of the term of the original warranty or for a period of three (3) months after return of the repaired or replaced product to the customer, whichever is longer.


What other limitations apply to this warranty?
The claims procedure and remedies set forth in this warranty constitute the sole remedy of a customer of CRC purchasing a product manufactured by CRC and the sole obligation of CRC with respect thereto. Without limiting the generality of the foregoing, this warranty is in lieu of all other warranties, whether express or implied, including without limitation, implied warranties of merchantability and fitness for a particular purpose and implied warranties arising from course of dealing, course of performance or usage of trade. CRC shall not be liable for indirect, incidental or consequential damages (including, without limitation, for loss of profit or revenue) secondary charges, or other loss or expense resulting from:

  • Any alleged defect in any CRC product to which this warranty applies;
  • The failure of any CRC product to operate properly;
  • The negligence of others;
  • CRC's negligence;
  • A claim for which strict liability is imposed; or
  • Any other reason.

CRC is not obligated under this warranty to bear any labor costs for field replacement or system malfunction of items of equipment with which the product is used. The customer is solely responsible for determining the suitability of the product purchased from CRC for its intended use. CRC expressly reserves the right to make design changes at any time without any obligation to modify products previously shipped by it, and to discontinue any products without prior notice or incurring any obligation.


Who has the authority to amend this warranty?
Only the president or an executive vice president of CRC has the authority to amend this warranty. No other employee or agent of CRC, and no distributor of the product or other individual is authorized to amend, modify or extend this warranty in any way, on resale or otherwise.


Does CRC warrant products that it sells that are manufactured by other parties?
No. Products manufactured by other parties are sold only with such warranty as may be made by the manufacturer of the product.


Does the customer have any additional responsibilities under this warranty?
Yes. The customer is responsible for proper installation and use of the product in accordance with the manufacturer s instructions. Any deviation from this will render this warranty null and void. Additionally, the customer is obligated to pay for the products it purchases, and any items not fully paid for within sixty (60) days from the date of invoice shall, from and after the expiration of such sixty (60) day period, be without any warranty whatsoever.
